1. ASSUMPTION OF RISK
I, the undersigned, understand that physical exercise, use of gym equipment (including free weights, machines, and cardio equipment), and participation in group classes or personal training involve inherent risks. These include, but are not limited to: muscle strains, broken bones, cardiovascular incidents, equipment failure, and even serious injury or death. I voluntarily assume all risks, known and unknown, associated with my use of the Facility.
2. RELEASE OF LIABILITY (EXCULPATORY CLAUSE)
To the fullest extent permitted by Utah law, I hereby RELEASE, WAIVE, AND FOREVER DISCHARGE BUILD Ventures, its owners, employees, and agents from any and all claims for ordinary negligence arising out of my use of the Facility, equipment, or participation in any programs. This release includes, but is not limited to, claims for personal injury, property damage, or wrongful death, even if caused by the negligence of the Facility or its staff. Note: Per Utah law, this does not release the gym from "gross negligence" or "intentional acts."
3. INDEMNIFICATION & HOLD HARMLESS
I agree to INDEMNIFY AND HOLD HARMLESS the Facility against any and all claims, suits, or actions of any kind whatsoever for liability, damages, or costs (including attorney fees) brought by me or any third party (including my guests) arising from my conduct or use of the Facility.
4. HEALTH REPRESENTATION
I represent that I am in good physical condition and have no medical reason or impairment that might prevent me from using the Facility. I acknowledge that BUILD Ventures did not provide medical advice and recommend I consult a physician before beginning any exercise program.
5. UTAH STATUTORY RESCISSION RIGHTS
NOTICE TO CONSUMER: You may rescind this contract by emailing or mailing written notice of your intent to rescind to admin@buildlifework.com or 2713 S Highway 89, Wellsville UT 84339 before midnight of the third business day after the day on which you execute this contract.
6. CONTRACT TERM & RENEWAL
● Term: This contract shall have a term of 36 months.
● Automatic Renewal: This contract will automatically renew. Notice of renewal will be provided to you between 30 and 60 days prior to the renewal date.
7. ASSIGNMENT & LOCATION CHANGE (Utah Bold Disclosure)
BUILD VENTURES MAY ASSIGN THIS CONTRACT TO ANOTHER HEALTH SPA REQUIRING THE CONSUMER TO OBTAIN A CONTRACTED HEALTH SPA SERVICE AT ANOTHER FACILITY WITHIN FIVE DRIVING MILES FROM THE CONSUMER’S INITIAL PRIMARY LOCATION.
8. RULES & CANCELLATION
I agree to follow all posted rules and regulations. The Facility reserves the right to terminate membership for any violation of rules without a refund. Cancellation for reasons of death, disability, or relocation (over 15 miles from a facility) will be handled in accordance with Utah Code § 13-23-5.
9. 24/7 UNSTAFFED ACCESS & SECURITY
BUILD Ventures offers 24-hour access to the Facility for members. By signing this agreement, I acknowledge and agree to the following:
● Unsupervised Use: I understand that the Facility may be completely unstaffed during late-night or early-morning hours. I use the Facility at my own risk during these times.
● No "Tailgating": I agree not to allow any other person to enter the Facility using my access credentials. Allowing a non-member to enter ("tailgating") is a breach of security and will result in an immediate $25 penalty fee and/or termination of my membership.
● Emergency Protocols: I acknowledge that there is no staff on-site during unstaffed hours.
● Surveillance: I consent to being monitored via 24/7 video surveillance for security and safety purposes. I understand that these recordings are the private property of the Facility.
10. PHOTO & MEDIA RELEASE
I hereby grant BUILD Ventures, its representatives, and employees the irrevocable and unrestricted right to take, use, and publish photographs or videos of me taken within the Facility or at gym-sponsored events.
● Usage Rights: This includes use in any printed materials, social media platforms (Instagram, Facebook, etc.), website content, or advertisements.
● No Compensation: I waive any right to inspect or approve the finished product or any "advertising copy" that may be used in connection therewith. I understand that I will receive no financial compensation for the use of my image or likeness.
● Release of Claims: I release BUILD Ventures from any and all claims, including libel or invasion of privacy, arising out of the use of these materials.
I HAVE READ THIS AGREEMENT, FULLY UNDERSTAND ITS TERMS, AND UNDERSTAND THAT I AM GIVING UP SUBSTANTIAL RIGHTS, INCLUDING MY RIGHT TO SUE.
